This Privacy Policy describes how Herald, operated by Apex Empire AI ("we," "us," or "our"), collects, uses, and protects information you provide when using the Herald application and related services. By using Herald, you agree to the practices described in this policy.

Herald is a personal AI companion, not a medical device, healthcare provider, or licensed medical professional. Herald does not diagnose, treat, cure, or prevent any medical condition or disease. Any health-related information Herald discusses is based solely on what you have shared conversationally — it is not a medical record, clinical assessment, or substitute for professional medical advice. Nothing Herald says should be relied upon as medical advice. Always consult a qualified healthcare provider for any medical concerns. If you are experiencing a medical emergency, call 911 immediately.

Herald is not a registered investment advisor, broker-dealer, financial planner, or financial institution. Herald does not provide investment advice, financial planning, tax advice, or recommendations to buy or sell any security, asset, or financial product. Any financial information discussed within Herald is for general informational purposes only based on what you have shared, and does not constitute professional financial advice. Nothing Herald says should be relied upon as a basis for any financial or investment decision. Always consult a qualified financial professional before making financial decisions.

1. Information we collect

Herald collects information you provide directly through conversation and onboarding:

Your name, location, and email address (if provided)
Preferences and interests you share in conversation
Life events, appointments, and reminders you ask Herald to track
Health-related topics you mention conversationally (not stored as medical records)
Financial topics you mention conversationally (not stored as financial records)
Device location data (GPS coordinates, used to provide local context)
Usage data including messages sent and features used

We do not collect payment card information, government ID numbers, or Social Security numbers.

2. How we use your information

We use the information we collect to:

Provide and personalize the Herald experience
Remember context across conversations so Herald can help you more effectively
Send proactive reminders, briefings, and alerts you have requested
Improve and develop Herald's features and capabilities
Communicate with you about your account and Herald updates
Comply with legal obligations

3. What Herald stores — and what it does not

Herald stores conversational context — things you tell us — to make the experience personal and useful. This is different from clinical or financial records.

Herald does not store your medical records or act as a healthcare records system
Herald does not store financial account numbers, brokerage credentials, or tax records
Herald does not access your bank accounts, investment accounts, or credit information
Herald does not share your personal information with advertisers
Herald does not sell your data. Ever.

Conversational data (what you share with Herald) is stored securely on servers in the United States. It is used only to power your Herald experience.

4. Location data

With your permission, Herald accesses your device's GPS location to provide local context such as weather, nearby recommendations, and location-aware reminders. Location data is used in real time and stored only as a general city-level label to improve future responses. We do not track your precise location history or share your location with third parties.

5. Data sharing

We do not sell, rent, or trade your personal information. We may share information only in the following limited circumstances:

With service providers who assist in operating Herald (such as hosting, email delivery, and error monitoring), under confidentiality obligations
When required by law, court order, or government authority
To protect the safety of any person in an emergency situation
In connection with a merger, acquisition, or sale of Herald — you will be notified of any such change

6. Data retention and deletion

We retain your data for as long as your account is active or as needed to provide services. You may request deletion of your account and all associated data at any time by contacting us at herald@apexempire.ai. We will process deletion requests within 30 days.

7. Security

We use industry-standard security measures to protect your information, including encrypted communications (HTTPS), access controls, and secure server infrastructure. No method of transmission or storage is 100% secure. We will notify you promptly in the event of a data breach affecting your personal information.

8. Children's privacy

Herald is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, please contact us and we will delete it promptly.

9. Your rights

Depending on your location, you may have rights regarding your personal information, including the right to access, correct, or delete your data, and the right to object to or restrict certain uses. To exercise any of these rights, contact us at herald@apexempire.ai.

10. Changes to this policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy at apexempire.ai/privacy and, where appropriate, by email. The effective date at the top of this page will reflect the date of the most recent update. Continued use of Herald after changes are posted constitutes your acceptance of the updated policy.
